The following was compiled from the magician's message section of
MAGIC!(tm). MAGIC! was an electronic communications system for
magicians. Access was free, except for normal telephone company
charges. New registrants were required to leave a comment with
their name, address, phone number and a brief resume of their magic
background to be considered for membership. The material herein
should be treated as confidentially as other magic information.

If you know something that can be unique about the header -- the part
of the message that has the message number, the "from," the "to," and
the "Re" in it, then you can find ANY active message on MAGIC! Here's
how...
>From the Main Menu...
o Type R? (that's the letter R followed by a question mark).
o Press the ENTER key.
o Enter the number of the earliest message you want to begin
searching at.
EXAMPLE: 5500
o Press the ENTER key.
o Enter the SECTION NUMBER if you are prompted to do so.
EXAMPLE: 13 (all MAGIC! messages are in section 13, some
private messages are in section 0).
o Press the ENTER key.
o Enter the name or term you wish to search for.
EXAMPLE: KAPS
o Press the ENTER key.
The system will now search for and present all available messages in
which the word KAPS appears somewhere in the header!
Note 1: You can do it by using the semi-colon (as you would in R;*)
but with all the required information I find it easier to use the
prompts.
Note 2: The same approach will work with S? to Scan instead of
Read, and Q? to Quickscan instead of Read, but I find that if you
are looking for something you will generally want to read rather than
scan.

Yep, I was in broadcasting, and yep, I left it for just the reasons you
mentioned. I saw too many corpses wandering around. It was fun, but
it did too many strange things to people's heads.
I've had a very strange background - done a lot of things - let's see,
I've sold soap, done radio and television, taught mentally retarded
junior high school kids, taught at a couple of Universities, run a
couple of companies, er, I forget all the stuff (a big advantage of
encroaching senility that is often overlooked, probably because those
of us who can't remember stuff don't remember what it was we forgot).

Are you asking a computer question, Marvin? Gee, you coulda done that
at the luncheon.
Since you are reading the messages "off-line" (not live on MAGIC!), how
you can answer depends on the word processor you are using. Some, like
WordStar and WordPerfect will allow you to open a second window on your
screen and to type your reply while looking at the message. You can
then store the message with a name - I usually give mine a name that
relates to the person I'm replying to - if I was replying to your
message off-line, for example, I might name the reply MARV0125, the
first four letters of your name and the date.
If you can't open a second window to work on a reply, you can print off
the messages you want to reply to and then exit from the messages file,
and construct a reply to each message, saving each as a file.
Lastly, you can note the numbers of the messages you want to reply to,
go back onto MAGIC! and read and reply to each of those individually.
The above will depend on the wordprocessor you use and the style of how
you like to do things.
TABMAN may also have some suggestions on how to do this.
Lastly, if you have the messages written into files like types one and
two above, you make sure they are in ASCII format (Joe can help you
with this), then you sign back onto MAGIC!, read the specific messages
you want to reply to and send ("upload") your replies.
That's the outline - it is really simpler to do than to explain. If
you remind me of the specific communications program and specific
wordprocessor that you use, I'll be glad to help with specific
instructions.

Thanks for putting the luncheon together, Darrell. I too think it was
a great success. Many of us now have a person to put with a name.
A couple of things to add - T.A. Waters was also there. I hope that
no-one thinks I'm running around hawking Final Words - I only got a few
'cause I got a good deal on 'em and figured I would pass it on to
interested MAGIC! members with the proceedes to go to MAGIC!
Will be looking into that great idea of a colored backplate for the
Magic Castle lapel pin as a way of identifying MAGIC! members - more
subtle than the buttons for the L.A./Castle folk.
I can hardly wait for next year's MAGIC! luncheon. 'Til then, with a
break for the MAGIC! Anniversary meeting at Desert Magic and the
MAGIC! gathering at IBM, I'll be right here watching the lights blink
on the modems.

Whether using an honorary doctorate in front of one's name is in poor
taste is a matter of opinion; while you may disagree with Booth's use
of it, the fact is that he has a right to it, and thus your use of the
quotes is perhaps questionable. I can understand why you might have
commercial reasons to wish to denigrate Booth, but I am not sure a
public computer BBS is the place for it.

I appologize for the lengthy delay but when it getz cold
my computer cubby gets that way too. No heat in this end of the
mansion, plus a coupla of daze ago when I went into the kitchen
a 3 inch hot water feed for the boiler had burst from the cold
and it was raining in there...a portion of the inch thick plaster

A few days ago I received a small piece of magic history
in the mail. The sender, who shall remain anonymous for the time
being, requested it be placed on the MAGIC! auction block to help
the great computer network fiscally. I was thinking about keeping
it and disappearing with the prize, but I'd miss everybody sooo
here it is...
I'll not reveal exactly what it is yet, but it will
suffice to say that this instrument carries the signature of Joe
Berg famous Chicago magic dealer and the signature of my fave,
Theo. Bamberg. It is fifty years old and quite special.
What I've decided to do is make a handsome mahogany frame
in the tabman shop in the style of a Thayer handkerchief frame
and mat it with Okito's favorite colours. It will be quite
beautiful and should make anyone with an awareness and sense of
magic history very happy.
I'll post the first notice soon as its ready to go..

Indeed, writing without checking facts seems to be endemic to a LOT of
magic writers. It turns out that the New England School Of Law (as it
is now known) DOES NOT give out honorary degrees for speaking
engagements or honorariums. In Booth's case the doctorate was awarded
by the President of the University for Booth's accomplishments as a
writer -- and to give a level on this, the only other honorary
doctorate that year was awarded to the head of the Massachusetts
Supreme Court, and the next one to the U.S. Secretary of State.
I hope that Busby and Whaley's research on the person they seem to
think was Erdnase is somewhat more complete than their research on John
Booth.

...and the fact remains that Booth knew Anneman personally, Anneman has
written about Booth, and I for one give weight to PRIMARY sources such
as Dr. Booth. I really don't recall ever having read any Anneman
references to or mentions of Busby in THE JINX. Mr. Busby is certainly
entitled to his historic perspective regarding Anneman and anyone else
for that matter. His opinions are of interest here but opinions when
combined with personal experience, (as is the case with Dr. Booth and
Anneman), are of even greater merit.

the Convention Center across from Disney Land, There is a large
Computer trade show there; and I have been hired the last several

backstage crew, She is 13, and has been doing magic since she was
seven, (at least that is when I started sawing her in half, she
is now doing birthday parties, when not helping me as an assistant.

I was in Germany and Iceland with the Air Force and our address was APO
or FPO NY for overseas military personel. But there is also APO or FPO
San Francisco for overseas military personnel so it does make a

We have the following available: all 3 issues of Pallbearers Review
and 40 issues of Hugard's Magic Monthly. I've put them on the side for
you, let me know if you want them. Both Hugards and Pallbearers are
great magazines. I really enjoy reading them. Have a complete set of
Hugards and an almost complete set of Pallbearers (those darn Folios,
will I ever find all of them).
It is cool down Houston - I had to wear a long sleeve shirt today!
Just kidding, it has been down in the 30's almost every night.
The Burger books are neat. I like things that make me think. Just
wish I did more of it! Actually, my problem is that I quit thinking
too soon. As for the philosophy, I like that kind of stuff. It makes
great beer talk. My favorite lately, it's a take off on an old
(centuries old) paradox, is "Can God write a check so big even He can't
cash it?"

You asked about Ibidem. It is one of my favorite magazines. They
are a lot of fun to read and kind of neat just to look at. Pat Lyons,
the editor's wife, besides being a very nice person, is a commercial
artist and did some really great artwork for the covers. The magazines
are very hard to come by and go for a nice price. I've been fortunate
enough to collect all but issue 11 (and would give my right arm for
it). Some of my issues aren't in the best shape as they are hole
punched and I would like to replace them. When I do this and get issue
11, the file will be one of the prizes of my library.
A couple of other things. David Ben, in Canada, has the best set I
have ever seen. His set is practically mint and includes a couple of
items that weren't sent out to everyone. Jeff Busby, here on MAGIC!,
was (is) the dealer for the last issue. You might check with him on
that issue.

I'm still trying to recover from a kiddie show I did this afternoon.
I think the superbowl looked easy compared to what they put me through!
I have a lot more sympathy and respect for all of those hardy souls who
can actually make a living working with miniature Tyranasauras Rex's.
(After a few beers I'm not so sure about spelling.) I've seen more
polite hecklers in biker bars. I really needed one of those "Final
Word" electronic gizmos with a loudspeaker. A cattle prod might have
come in handy also for those that insisted on climbing up the table
legs and stealing furtive glances behind the scenes. I definitely need
to read up some more on this aspect of performing as there is some room
for improvement of my handling of an unruly mob. Well, at least I
didn't get lynched and left with most of my props intact. Looking back
on this invaluable learning experience I would say that most of the
favorable responses came from magic of my own design and the stock
stuff from the magic store shelves was apparently to commonplace for
them to suffer through. Next time (if there is one) I will concentrate
on more original magic and leave the stock stuff for the 1 to 2 year
old groups who hopefully haven't seen it yet. So here I go, back to
the drawing boards!

Sorry we don't have any of the G rated Final Words, although with the
crowd you were facing it sounds like the X rated version would have
been just fine! I just recently had a group of kids doing much the
same. Hard to control. One suggestion is to get them involved early
- don't perform for them as much as involve them in doing stuff. Once
you've got them interested you can go on to a more routine performance.
I've used stuff like origami to accomplish this. I pass out the sheets
of paper and they have to follow my folding in mime. Gets real quiet
for a while. It won't work with all age groups and all types of kids
though.
How about some others - how do you handle kiddy hecklers?

That's why I asked. I know I'm a friend, I'm not sure of the rest. I
will be moving at the end of Feb. I'm not sure where. Use the P.O. Box
for any correspondence. I was on a 2 day suspension from work. My boss
is maniacal. It's a long story. It's for the phone not for this forum.
A friend said I can stay with him until I get on my feet. Bartending
school will be starting in Feb. I think I will enter to have a
refresher course. The next couple of months will be brutal. I'm moving
my clothes, computer, some magic and my phone. The rest will go into
storage.

Its warmed up a little bit here in the mid atlantic so
I'm back at my typer for a while and wanted to reply to your
last message re: the music city magic conclave. Rick Ruhl is with
us on this. I don't know anybody in Birmingham to help, but can
probably get help in Louisville (anybody listening)....
As far as date is concerned looks like its pretty open in
January. Lets all do some asking around about a date close to new
years and see how people feel about it. The reason I put the
starting time for the first lecture late was to give magicians
coming in from Atlanta time to drive in and get settled.
There is a fair possibility I'll be driving down to music
city sometime in the next few weeks to look at a farm and see
some associates so make sure I've got your phone ## so we can get
together and go look at a couple of hotels with MCCM in mind.
As far as lecturers are concerned, there are a few I
personally want to see. To me, most impt is what the potential
attendees want to see. Don't hold us to it, but some I've thought
about are Michael Ammar, Max Maven, Ray Mertz, Eugene Burger, Ben
Harris (only if he's already in USA), Lou Gallo, David Roth.....
I'd imagine a good bar magician could easily make a
couple of hun a night (especially with tips). Ray Mertz is one of
these. He lives in Buffalo, also Harrison Carroll who isn't a bar
magi per se, but I've seen him work behind the bar to excellent
result.....then of course there is Doc Eason (who does a great
lecture also).....tabman.

* Deep in the bowels of the thriving metropolis of Little
Rock, Arkansas is a magical oasis. The oasis is called the
"Free Museum of Magic". It serves as a museum of sorts and
has many visitors (especially young school children) who come
to see what magic is all about. The museum is owned by
Colonel Frank Seymour, S.C.C. The title "Colonel" was not
conferred because of his prowess on the battlefield, but is
the honorary title of "Southern Colonel" and was bestowed
upon him by the Governor of the State of Arkansas many (many)
years ago. The "S.C.C." is the Colonel's own title, which is
short for "Southern Colonel of Corn", which he used in his
days as a stage magician.
* When he was forced to retire some years ago, due to illness
in the family, he managed to buy the house next to his and to
turn it into a clubhouse for magicians where he conducted
magic lessons for would be practitioners of the magical arts.
How many young people he trained cannot really be estimated.
Several, however, have gone on to make magic an important
part of their lives, becoming either full or part time
magicians. The Colonel, thankfully, is getting older
(consider the alternative) and, while he continues to take
an active part in the enterprise, has a full time
manager/partner - Frank Pinto - who takes care of sales, acts
as a talent agent for other magicians, coordinates museum
visits and other day to day functions.
* The museum boasts "6,000 tricks on display", both amateur
and professional. I don't know exactly how many tricks are
there, but if it isn't 6,000 it's close enough! Everything
from inexpensive pre-packaged tricks to full blown stage
illusions are there. I doubt if there are too many things
that have not passed through these doors at one time or
another.
* The museum hosts the "Little Rock Magic Circle", a club of
tired and tireless magicians from around the area who meet on
the second Friday of every month at 7:00 P.M. until the last
holdout leaves. Every Sunday an informal roundtable is held
at 2:00 P.M. (until whenever) where the members try new
routines out on their peers for cheers or jeers. The
meetings are casual and fun.
* For those who may be in the area and would like to stop in
for a visit the address is 5200 West 29th Street, Little
Rock, Arkansas, 72204. The telephone number is (501)666-2159
and works most of the time since the Colonel has stopped
doing his own wiring. The address works for mail too, if you
want to write.
* This is truly the fun spot of Central Arkansas for
magicians. New York, Los Angeles it ain't; but maybe that's
why I like it.

Yes, Michael Moschen received the MacArthur Foundation grant around a
year ago -- with far more justification than some others, so far as I
am concerned.
Regarding my ongoing shows at the Comedy Store, it's proving to be
a difficult room in terms of drawing numbers; because the Belly
Headliner venue is used only sporadically, it has no established
identity, and I know that some potential customers have gone into the
Original Room show downstairs, assuming incorrectly that I am one of
the performers on that bill. However, the room itself is nicely
arranged, very intimate, and the audiences may be small but the
reactions have been terrific.

Okay...
Of the MAGIC! members who attended the Magic Castle Lecture by Gary
Kurtz...what didja think?
I thought it was among the best, if not THE best lecture I've EVER
attended! The information was valuable and well-presented. The
effects were strong and he really didn't hold back...(unlike some
recent lecturers at the Castle). I do hope that those of you who are
locals and didn't get to the lecture at least got to see Gary's show
during the course of the week. If you didn't get there, you really
blew it!

In my own way I tried to involve the kids from the very start and
throughout most of the show. I started by showing two toothpicks that
I had painted to look like magic wands. By themselves they wouldn't do
anything- the kids had to say the magic words and the magic words
for the day were "Happy Birthday". When they said the words one of the
toothpicks jumped a foot in the air. (I told them if they watched real
close they might see it quiver a bit!) Anyway, whenever we needed some
magic words I had them all chime in together.
Looking back over how it went it seemed like they viewed not so much as
a performance of magic, but as a series of puzzles to figure out how I
did it or blurt out how I was doing it as the case might have been.
Though they may never have been correct they sure had plenty of
opinions as to how I was doing things! A few magicians have mentioned
not to "talk down" to kids. I'm not exactly sure what that would be
but it's probably what I did. One of the grandmothers in attendance
said I seemed very kind and gentle and soft spoken like a magical Mr.
Rogers! Well these kids were nine years old and I guess that's a bit
too old to be spoken softly too. I guess they are getting to be
sophisticated adults younger and younger nowadays! I think I just need
several more trials and errors to get the feel of working with kids.
It'll all smooth out with practice.

I thought I was told it was Mettler's Metrolock #100. I made the
assumption from the "-lock" that it was the type used by overlock
serger sewing machines, which normally are on BIG spools not the
regular sewing machine spools.
I have seen the brand Mettler's but only rarely and always in small
colored spools. I think the #100 refers to the thickness of the thread.
The #100 cotton threads I've seen in the other brands appear too thick
for use.

Next time youwork Anaheim go up the street one block to Belle Isles
restaurant on the corner of Harbor and Chapman. It's an ugly pink
building. You can't miss it. Check out the bakery counters and take
home a souvenir menu. They feature extremely large (and great tasting)
portions. Their pies are taller than they are wide! To look at them
reminds me of the old cone-head skits on saturday night live. Go there
either for a a meal OR for dessert. You'll be too full to eat both.
They are open 24 hrs. I'd suggest one of the desserts. Everything is
made right there including the ice cream. The whipped cream is so thick
you can stand a fork up in it. Look at the Texas breakfast listed in
the menu. Meant for only one person it begins with a 32oz steak, 1 doz
AAA eggs anyway you'd like 'em, ham sausage AND bacon, 1gal of coffee
and a bunch of things I can't even remember.
Congrats on Alison's TV debut. What did she invent?

line from Al Koran's lecture and delivered it (slightly modified):
"There are horses for different courses, I'm NOT a horse for THIS
course, God Bless you and Goodnight!" Then you just leave. I modified
it, following the comma with F**K YOU AND GOOD NIGHT!

Here is the incredible true story of Jasper Maskelyne, The grandson
of John Nevil Maskelyne, founder of the famed Magic Circle. Though
grandfather and father Nevil Maskelyne were famous for their stage
performances, Jasper created even greater miracles for the allies in
WWII. Stationed in Egypt, Jasper used his magical talents not to
entertain but to defeat the Nazis in the mid-east. Many of Jaspers
techniques are still being used by military units throughout the world.
This well written book reads like a novel and there are several
photographs of Jaspers work. After enlistment the British didn't know
what to do with him so they assigned Jasper to the Royal Engineers
Camouflage Corps. While still training in Britain, he used mirrors to
sucessfully hide a machine gun nest and ambush Lord Gort, the Inspector
General of the British army who was inspecting the camouflage training
center. He then created the illusion of a German warship floating on
the Thames.
Realizing Jasper's ability to produce armaments from thin air, Lord
Gort had Jasper transferred to the mid-east where there was a terrible
shortage of men and materiel.
Upon arriving in Cairo, Casper was immediately sent to Damascus,
Syria to have a "magic duel" with the Iman of the Whirling Dervish
tribe who was threatening a jihad or holy war if the British used an
evacuation route that ran through Dervish territory in what was then
Palestine, Transjordan, Syria and Turkey. This "duel" was similar to
ones his father Nevil Maskelyne had performed on behalf of Lawrence of
Arabia years before.
After Jasper's sucess against the Iman, Jasper was assigned as the
head of the Camouflage Experimental Section and given near complete
autonomy. Jasper's unit was vital to winning the war in the mid-east.
He created armies, tanks and battleships where there weren't any. This
caused the enemy to waste valuable resources attacking useless targets
and prevented attacks on units that otherwise were not strong enough to
resist. He transformed tanks into harmless looking supply trucks so
enemy planes would pass them by. He designed spy equipment for the OSS
and escape tools that could be hidden in the uniforms of pilots in case
they were captured.
Perhaps the biggest illusions were the ones Jasper had to perform
nightly throughout the balance of the war. These illusions were bigger
than anything performed before or since. Jasper Maskelyne vasnished the
Suez Canal and Alexandria Harbor nightly so that enemy bombers could
not find them and would bomb useless sand dunes instead. Here for the
first time his methods for these feats are revealed.

Hi Pete -
Have been on the boat for almost 8 weeks and did a T.V. and magic
weekend in Belgium. So no time for writing - As a matter of fact
apart from the T.V. and the magic weekend. I did not touch a
prop!!! <>.
The weather has been fantastic! It is a little cooler now
but we go back to the boat tomorrow for the weekend. I start
working again on the 5th of September. And it will be a busy
season again. 19 shows in Sept. 23 shows in October. Nov. and
Dec. will be very busy too!
Sometime ago you wrote about coming over this winter -- are

Ken <> went back to the South of France again to do
another lecture in Italy and a holiday until the end of August
with our friend Phillipe Fialho. It will do him a lot of good.
Barbara is with him this time. Last time he went to do the Monte
Carlo Convention he could not believe his eyes. With Fialho he is
in very good hands!
Hope Jay's <> show in Chicago in Oct. 1976 will
work out. Did not get any letter from him yet, but hope he will
be able to book me.
Nelly's foot is almost healed now. 1st of September the
plaster comes off. It was a big disappointment for her. She was
not able to travel to Monte Carlo and we could not go on our
planned trip with the boat so we stayed on the lake. She is
alright now.

Another approach would be to avoid booking shows where anyone between
the ages of 7 and 27 is likely to be in attendance. The toddlers don't
seem to present the problem and the older folks will either enjoy the
show without being obstreperous or at least they are old enough to
blast with the Final Word. You will notice that the Castle wisely has
a policy of not admitting anyone under 21. Up until now you've thought
that was because they serve booze - now you know that it is for the
protection of the performers.
Have you considered doing your show in costume? Perhaps as a Teenage
Mutant Ninja Turtle? (A friend of mine points out that it was a wise
decision of the producers of that show not to model it on Jews - can
you picture a Teenage Mutant Rabbi Whitefish?).

It should be noted that Fisher's book is heavily based on Maskelyne's
own MAGIC - TOP SECRET; Fisher has given the events a novelistic feel,
but didn't add a great deal of new information. On the other hand, the
Fisher book is readily available and Maskelyne's isn't -- given that,
Fisher's WAR MAGICIAN is certainly worth reading.

nowhere exists a more supportive league. You are part of the data

While MAGIC! is apolitical, we do have to depend on the
phone lines to "talk" so we fight for freedom in our own way. Ten
years from now the 90s will be considered the end of the dark
ages as far as magic is concerned. Communication is instant and
the value as perceived by me is far greater than the cost of a
call.
I wanted to join those of you who lunched at the castle
last friday in the worst way. I even had chile for lunch though
on the east coast most of you were just getting going for the
day. I know it'll happen and I will get to meet many of you along
the way. I still have my east-west plane ticket (fortunately not
on eastern) and plan to use it for the desert seminar assuming
Gloria is home, even if I come in just for the MAGIC! breakfast
(guess I'll have to bring my own gritz).
This decade is less than 30 days old. The last hoorah for
the 20th century. We must weave the threads of this network deep
into the fabric of global communication before the data police
are formed. Magic must have its own satellite and it must be
invisible. Black art?

You know Pete, if this music city magic does come through, I think I
WILL perform ZIg-Zag the way Harbin did. I would love to see the

About performing in costume- I don't know that I have a definite style
yet but any costume would certainly be out of character for me and I'm
not that good of an actor to portray something too far afield of what
I am. I have heard that magicians are simply actors playing the part
of a magician. That, I can manage. Putting on a turtle costume and
making pizzas appear while yelling "Kowabunga dudes" may be a big hit
commercially but it's not for me. I think I will just have different
shows for differet groups according to age brackets. After reviewing
the tape I made of the show I see that I could have done more effects
with money which they really liked and cards which they understood
better than I thought. I will certainly not be buying many more of the
stock shelf items found at my favorite magic store but I'll concentrate
on creating some unique ones of my own. With a little thought I might
be able to cover 90% of my requests for shows with one of three
different shows. One for LITTLE kids, one for older kids and one for
adults. One thing I like to do is modify each one specifically for the
person or group I will be in front of. Makes it a little more special
that way. For instance, I asked the mother what the birthday girls
favorite color was which she said was blue. So after I turned a yellow
silk into a red one I said I would do it one more time and asked the
birthday girl what her favorited color was. I then changed the silk
into her choice, blu There's probably lots of stuff to do along those
lines that we can do to personalize the show a bit without resorting to
totally revamping it.

I used to play Cajuns Wharf there in Little Rock and
Nashville. Nashville closed but don't know about Little Rock. Was
a great stop along the road. Good money and good food. I remember
"Col" Seymour. Glad to hear he's still magicking. Used to see his
ads for the Col. Seymour school of magic which I think he ran out
of a motor home in shopping center parking lots. I never got to
go to magic skool, but I did go to law school for awhile...same

You got it! When I saw Harbin do it this way it really made a
difference. Again, he worked primarily in Cabaret with the audience
close and all around him. I have a model built right from the book,
but it needs some repair. I bought it to use as a closet for my
jackets, etc.. Might re-instate its use when I move into MY OWN PLACE
next few weeks!

I've been having tremendous luck with kid shows recently so
I thought I would share some thoughts.
Kids these days ( as well as adults ) don't get to see live
performance very often and its my opinion that they really
dont KNOW HOW to watch one. I tell the little b*stards (oops,
I meant cherubs ) at the beginning of the show that this is
not t.v. , I am a live performer and my feelings can get
hurt. I tell them that if my feelings get hurt I might cry
and will have to leave.
I then explain that one kid can destroy the show for
everyone. Handling child hecklers is a little different than
adults because the "position of power" concept as discussed
by Max Maven is especially great. You have to handle them
without losing the sympathy of the audience. First I try to
ignore the heckler, then I try to incorporate him into the
show and if all else fails I sternly, but kindly, inform him
that he is making the show bad for everyone. (Diplomacy is
vital at this point.) You should be friendly but command a
certain sense of authority with a kiddie audience.
The best way to handle an unruly audience is by prevention.
Proper selection of material, appropriate (possibly the most
important word in magic) presentation, and thoughtful
routining of the act as a whole.
For trick selection I use basically the same stuff as I do
for adults. I dont do any "kiddie" magic. I obviously dont do
wine magic for them but substitute water and milk.
Your presentation should be changed to match the audience.
Nine years olds dont react the same as five year olds.
Younger kids still can enjoy fairy tales and so forth but a
nine year old wants to match wits. Modify your routines
accordingly.
Above all, think about the routining of the act as a whole.
I start out with an eyepopper, move into some fast paced
stuff and then to a sucker gag ( to let them release that
urge to yell ). Now that I have their attention and the
spell is being woven, I can afford to move into material that
takes a while to build, or use jokes that require thought.
Some more brief thoughts:
Kids are very much in touch with their instincts. They can
sense when you are nervous and will often move in for the
kill when the time is right. Eliminate the tell-tale signs
such as shaky hands, high pitch voice and excessive UM's in
your speech.
Learn how the different age groups act. The difference
between a seven and a five year old is tremendous as
contrasted with a fifteen and a seventeen year old.
GIVE GIFTS. Kids love bribery. I close my show by showering
the birthday brat with tons of worthless crap ( I mean
priceless treasures ). Spend five bucks on a card, some
balloons, candy and toss in an autographed glossy and you
will be amazed at the response.
Kids are emotionally infectious. By that I mean the emotions
of one can spread very rapidly. The down side of this is
that one person can create havoc. The upside is that good
will can spread through a kiddie audience like wildfire.
One of my most enjoyable kid show moments was when I was
standing in front of an audience of kids who were laughing
UNCONTROLLABLY. It was like they had an epedimic of laughter
and nobody could stop them.
But the best advice I could give is this. In the
entertainment game the high points are very high and the low
points are very low. What can result is an emotional roller
coaster that is hard to handle. Thats why so many people in
this field self destruct. Enjoy the highs, learn from the
lows, but above all keep a level head and a quasi-passive
attitude. This way you can stay in the game long enough to
achieve the success you are after, whatever it may be.

Since we haven't experienced the future yet, it's hard to
say, however with each additional advancement in the "art" of
communication we have seen growth in most all areas of the arts.
I'd venture to say that your latest book FOCUS was "typeset"
using computer technology as do I imagine most all modern
publishers do likewise. And unless FOCUS was printed by hand
would also imagine computer technology aided in the printing
also. Not taking away from your book, on the contrary as you
certainly know how I feel about your work.
MAGIC! provides a sense of interactive community which is
impossible without some form of computer communication even if
you're using a simple telephone. While it can be argued that
where there is sufficient desire on the part of the student to
seek out knowledge little will stand in his or her way, we've
just started "cracking the nut" as they (me) say.
I do compliment you for being an active participant and
hope you value MAGIC! as much as I value you and your thoughts.

There is a hierarchy of activities that go into the "development of
magic," Max. Creation is one component. Diffusion and dissemination
are another. I suspect that to date creation has not benefited much
from computers (although there are many ways in which it could). But
diffusion and dissemination, and the creative feedback that results
from those, have certainly gained from modern communications technology.

OK, OK, here's the story... We are constantly looking for ways to make
MAGIC! better (and less expensive to use) but there are some things
that WON'T work. Doors, for example. They blow holes in the security
system and most of 'em won't work with multi-tasking, multi-user
systems.
Zmodem would be nice, as would a built-in message packer. Programming
is looking at 'em. But our programmer also maintains that the future
is with hardware based solutions such as MNP-5 and V.42, solutions
where the files are essentially "packed on the fly" via the modem. He
sees transfer protocols as a dying art.
All I can say is that we are working on improvements. As a matter of
fact, the next version of MAGIC! is already in beta test.

My comment had nothing whatsoever to do with the value of computer
technology. I value it highly, and it has made my work far easier in
many ways, both in the creative area and that of setting those ideas
into printed form. Unquestionably, the creators and/or authors in
magic's prior years would have enjoyed the opportunity to use such

My favorite books so far are the old books and admire
the men who made it all happen. Centeries from now most of the
books not well protected will have turned to dust. I'll make a
deal with you; lets talk about this some more over pasta and
espresso somewhere in Tennessee or California. My goal here is to
help make sure this information has a chance to carry forward not
to negate its value. It has more to do with storage and access
than to the state of mind of creators and writers as I view the
value of digital storage as precisely that - archival storage. As
to how well the antique masters did, it is obvious.
They made us aware of what they were doing at the time,
however not everyone has access to this information readily
outside those who are close enough to use the Castle library
regularly. Many of these writers were more motivated by love of
art than chasing a dollar as they didn't rely on their magish
skills to make their living.
I hope some one with the bucks required will take on the
responsibility of transferring all the old books to cd-rom
technology so they can be easily saved and used. I'd love to have
a complete Hoffmann on cd-rom. Modern Magic is one of my most
referenced books over the years and I've about worn my copy out
as it is almost a century old. A complete Genii reader and Sphinx
reader on cd-rom...man o man. I hope I get rich fast.
On another topic: would you be interested in coming to
Nashville next Jan to do a lecture ?? I'm not sure you even do
this anymore, but I thought I'd better find out.......

Just saw Inside Edition for the day and James Randi was
on debunking Dr. Nostradamus. Amazing Randi says the Astrologer
was wrong over 100 times as he traced discrepancies back to the
oldest version of THE CENTURYS he could find. Also was the first
time I'd ever heard the word "malarky" on television by a "news"
commentator. Randi looked good. Nice tan. He also did an
ambitious card for Joel.

I believe I have been there, your statement about the pies, is what

I do love to go to Anaheim, but I think that Rebecca's on Venice Beach
is my favorite place to eat. Great atmosphere; I do not wish to slight

What does anyone and everyone think about mixing magic and feats of
skil+l or comedy stunts? More specifically, does anyone do a routine
where they are doing, say, some card locations or whatever that come
across as "magic" and in the same routine perform a royal flush deal or
four ace deal or some other thing that shows obvious skill with the
cards and does not purport to be the illusion of magic? Along the same
line, When I was doing the last magic show for kids, all of the effects
I had were
"magical" types of effects except for one, the old paper balls over the
head routine. Looking back on it perhaps that wasn't a w-ise choice to
include if it burst the bubble of the illusion of events happening by
magical means.
One more thought if anyone can benefit from it. I had a scotch and
soda set which I held in my left hand so they could see both of the
coins. Closed the hand and let the birthday girl choose either the
copper or silver. If she would have said "silver" I would have said
"that's my favorite too. We'll keep the silver coin and vanish the
copper one." As it turned out, she chose the copper so I said "OK
since you chose the copper I will make it vanish. The two coins were
already locked together of course and I said to watch my outstretched
left fist carefully. While they did and just as I opened my fist I
stole a real centavo from a coin clip with my right hand. I then
produced this from the birthday girls ear and as I was leaning over to
do that I pocketed the shell and insert into my left pants pocket. I
said I would do it once more and placed the centavo into my left fist
as if it still held the half. I said "choose again, copper or silver"
She did what I expected and chose the other one which was the crux of
what I am trying to convey to you. I held my hand over a plate and
made the silver coin penetrate the plate to...
My screen just went blank- I hope I didn't lose the message.
Oh well, anyway, from the kids viewpoint the half dollar penetrated the
plate because when I lifted it up I picked up a half dollar which had
been there from the beginnin of the show.
Now of course the girl could have wanted to see the copper coin vanish
a second time but that would have required just a "sleight" adjustment.

Tabboo... did you know that the Jarrett Book (by Guy Jarrett) was set
in letterpress type one page at a time by Jarrett himself. He would
print a quantity of the pages, set 'em aside, then take the type apart
and write the next page AS HE SET IT IN TYPE, continuing until
finished.
And, And, that Jerry Andrus did a similar thing PRINTING BUT ONE COPY
OF A BOOK, sending it to Lloyd Jones. I wonder if Byron still has it?

Randi. Hah, an anecdote the Reel Works.
Following one of his wonderfulk debunkings of Urine...er Uri Geller on
a San Francisco TV station, Randi and I headed (in my car) to the
airport so he could catch his plane and go home.
When we got the to security checkpoint all the bells and whistles went
off!!! He went through again, DING DING DING...
"Oh, I Forgot" he said, "I have some big magnets taped on the inside of
my thighs" -- he had to go get 'em off to get through!!!
Hah! He had been doing the stuff that makes compasses and watches act
funny!

Also, a friend of mine (now a major editor at Business Week magazine)
who know I did magic and liked it, was listening to my story about
Geller jumping from New York City through the air to a town in upstate
N.Y. (I think Ossening) (it is described in one of his books) and
landing on the front porch of a guy named Andrija Pujarich (probably
spelled wrong) and this guy (at the time was assistant dean of men at
N.Y. University) went berzerk, saying,
Pujarich?? Man, I used to date his
daughter... that guy belived the little men from flying saucers used to
land on his property and talked to him!"

I've got the J. Steinmeyer JARRETT. Couldn't put it down
til I'd read every word. I'd forgotten he'd done that. I got
inspiration and insight into the "determined man" after reading
about how he'd put the book together. I hope if I ever have the
chance to own an original I have the money to buy it on the spot.
What kind of paper did he use? And the binding? Did he bind it
himself?
I like The Amazing Randi's work. He's really developed
quite a career out of debunkery. Thats a funny story about the
big maggies in his pants. Seems like you'd get magnet rash or
something.
Speaking of magnetism - are you familiar with the
Philadelphia Experiment? One of the old guys at the vets home
across the road claims to have been on the next ship over from
the Philadelphia the day they flipped the switch and turned those
giant electro magnets on. Also know a military consultant that
swears that the whole thing is true. Three electros with the
center one out of phase with the outside two. Would make a great
theme for a magical demonstration.
I think I'll call public affairs at the pentagon tomorrow
and disguise myself as a writer to try to get the scoop on mon
general's magic hobby. Will let you know if I can get on base or

My thoughts on combining feats of skill and magic are as follows.
Hey what the hell. If the result is unique and entertaining by
all means go for it. There are no steadfast rules so why not
stretch a little.
I am a fairly good banjo player and have played since I was a
kid. I play it during my bigger stage shows and I always get a
great response. Its not exactly combining magic and music per se
but the audience seems to like the variety. I do a medly of
tunes at a breakneck speed and it leaves them aghast.
I saw Mike Finney in Tahoe several years ago and he was
preceeded by a talented juggler. The juggler failed at a card
location at the end of his act he did some cigar box
juggling. Ultimately he stacked the cigar boxes in some
precarious fashion and balanced them on his chin. He turned so
the audience could see the back of the boxes and them was the
card revelation. A great combination of the two arts.
Hey, by the way I am going to fly into El Lay for the weekend in
May. Maybe we could get together for drinks or chow at the
castle.

Two of the worst types of audiences are drunks and obnoxious
children. Why the heck would I combine the two? Talk about
double jeaopardy.
My worst night club story, and granted I haven't as many years
in it as you, was right after the baseball season playoffs last
year. The crowd was left-over from watching the game and were
as drunk as can be. They were literally throwing things at the
other comedians and yelling swear words.
What could I do? What else? I rushed through the show to
fulfill the contractual obligation and called it a night. I was
somewhat proud of the fact that I didnt let it get me too down
in the mouth. I didnt lose any sleep over the incident and
chalked another one up to experience.
Ah well. Just another day in the small time.

"To:" As part of the start of MAGIC-NL in Holland on February 2nd,
Arnaud has suggested this new "user" as a way to direct your messages

say that he "failed at a card location." True indeed - but for Chip's

Maven's inspiration, I tried something different, and by Merlin's
whiskers, it worked!
Want to wow the almost-teens? Mentalism!
I performed a half-magic, half-mentalism show for them. Flash magic,
manipulation, and a few comedy effects, leading into the front half of
my adult mentalism routine. And do you know what? They bought it,
hook, line, and telekinetic timber! I hit 'em with Roydon's DOUBLE
DYNAMITE, then MENTAL EPIC, the TOSSED-OUT-DECK, and closed with the
TELEKINETIC TIMBER.
Believe you me, I would never have thought that mental effects would
go over so well. Nine-year-olds, indeed! From the looks on their
faces, I thought for a moment that I had an audience of true believers.
Even the ones that "knew it all", were floored when I suddenly
switched from doves and silks and gaudy colored boxes to simple props
and the magic of the mind....
Go figure, eh?

Dr. Magic sent us a video and the combined talent committee (me, Bill
Wells and Jim Nagel) of the IBM really liked it. It was a "first really
heavy metel look" rock and roll magic show.
Wanting always to bring new and innovative acts to the conventions we
booked him. I don't know his real name. He is from New York state.
Anyway to make a long story short, he and his assistants (about 7 or 8)
trucked into Boston with tons of stuff, lights curtains yoiu name it.
They worked day and night setting the show. We had lots of problems
with the union help (in the end they all appreciated one another) but
a bunch of Irish Union stage hands and long hair rock groupies at first
did not have ANY CHEMISTRY at all.
Anyway Doc was to do 2 shows with 1/2 the aud at a clam bake one night.
I and my committed decided to go to the clam bake the first night so
that we would see the 2nd show of the good Dr.
Well, with extention cords (hundreds of them) all over the audience,
lights rock n roll equipment etc.
THEY NEVER WERE READY. DID NOT GET TO REHEARSE.
I did not see it but it was a total disaster. At one point they nearly
set fire to the place (actually did singe the floor) assistantds that
vanished from one place to appear in the aud didn't get there due to
locked doors.
What could go wrong went wrong.
There is a "cult" of people that SAW THIS SHOW. Like John Gaughan, who
said "I wouldn't have missed it for the world", etc. etc.
The fire marshall told us if they tried to do the 2nd night the entire
convention would be closed down.
Sadly, I wanted to see them make it... I had to fire him on the spot.
By the next night we had assembled a great show and discovered some
really good talent. This in itself is a big story, but the magic
reviewers overlooked it.
Frankly, I hope Doc went home and thought it out and is still working
out a way to do it... and I would be the first to put him back on
stage.

Was thinking about taking a few daze off but I saw your
xmission regarding Dr. Magic and got to thinking about it while I
was in the other room holding the door letting some dogs in and
some dogs out.
Was there sabotage involved in the locked doors? Must
have been a horrible scene (for you and Dr. Magic & Co.) but
heard the pickup second show went off great. I would have loved
to have seen the fiasco. Is there any video?
Last year doing a show (rock music) at The Bayou in DC.
This brother was doing his mc bit (really hamming it up) when he
simply vanished. The stage being eight feet off the dance floor
and seating balcony style this dude got his foot tangled up in a
mic stand and was standing too close to the edge of the stage. He
fell on the last word and the band started with smoke, pyro, etc.
He just dissapeared. It was great. That moment of suspended time
and reality. The guys in the band thought it was part of the show
cause he vanished from their perspective also. A funny night.
Paul Osborne had his adaptation of zigzag for his 100th
plan in Genii I guess about 20 or so issues back. Seems that the
illusion has entered the public domain. Unfortunately for the
Harbin family no royalties (outside of book buyers) are paid for
this unique illusion. In the pre movie era, magical intventors
like Horace Golden would patent illusions (his or ??) and haul
people into court. Guess it was part of the hype too.
In speaking of Harbin Book, I wonder, does the license to
build transfer with the passage of the book or does it remain
with the original purchaser?

After reviewing my original post I agree that a clarification
was in order.
The Masters of Magic show featuring Chuck Jones, Jon Carney
and the Barans was the first casino show that we had ever
seen. We were greatly inspired by it, especially by the
Barans. My wife was so pleased to see Jennifer Baran playing
such an active role in the act, as opposed to the " Table with
Legs " role that too many female assistants are relegated to.
I felt the black art opener in that show was a very nice
touch.

on the precariously balanced cigar boxes was probably Chip Lowe. I saw
him a few weeks ago at the Castle and enjoyed his show immensely. That
is one art form which not only takes a lot of practice but there is no
hiding the fact when you make a mistake!
What weekend in May will you be down for? Sounds good to me whenever
you can make it. Will you be doing a show or is this a fun trip?
I'm still mumbling and fumbling with my thoughts on mixing skillful
manipulations and exhibitions of dexterity with "magic" in the sense of
some effect occuring by unexplainable means. I think I would prefer to
keep them separate. I would rather do one show of flourishes, poker
deals, and exhibitions of skill and at some other time do a show where
I try to weave the audience into suspending their belief for a moment
that my effects are created by unexplicable means. Just my own feeling
at this time. Along the same lines, I have seen many magic shows which
were actually standup comedy acts interrupted by brief bits of magic.
I guess they started out being magicians but found their real calling
was in comedy. Still hanging on to their thumbtip like a pacifier.
Maybe they think if the jokes don't go over tonight they can always
vanish a silk or two.

That really surprised me to hear what you succeeded with. Goes to show
you how much I know about kids. I didn't want to do any effects with
cards because I wasn't sure if they were all familiar with the makeup
of a deck. Apparently, they were more than just familiar- this
particular group had some bridge players! I'm not familiar with the

The Dr. Magic guys just forgot to or didn't take time to check out the
access. they wre just too far behind and going crazy trying to put the
show together. I thought I screwed them up in the afternoon as I was
standing my a huge wind machine set to blow confetti across the stage
and I made a noise and the machine went off blowing the confetti all
over the theater (ABOUT FIVE HOURSE TOO SOON) I was really upset
thinking it was sound activated and caused it. but they came over and
told me they did it themselves by throwing the wrong switch. It took
them forever to clean up the mess and re-set. Just one of dozens of
things they screwed up by not being ready or knowing what they were
doing. I'll tell you nobody worked harder than that crew. I felt really
sorry for them.
MY LESSON? Don't book acts with 'EDITED' tapes. I want one camera, no
cuts!

I agree that in most (%99) cases one should stick it out and
try to win as you say. This particular crowd had gone beyond
hostile, beyond obnoxious and well into that special form of
mental retardation that only sports fans are capable of.( I
know your a sports fan. No offense. Not every sports fan is
included in that last statement).
By the time I decided to throw in the towel these things had
happened. Several people had tried to rush the stage and take
the microphone from the comics. Comics were being smacked in
the head by flying objects. One female comic was called a
"Fat F****ing Whore". We actually threw 10 or so drunks out
on the street. After exhausting mine and everyone elses bag
of tricks for handling the tough ones, a conference with the
owner resulted in our ending the show prematurely.
We had some excellent performers working that night. All of
us agreed that this was the worst audience on the face of the
earth. Unfortunately there were several parties in the back
of the club who were trying to enjoy the show. I spent the
remainder of the evening doing tableside for them and
apologizing for the neandrathal invasion. In that respect I
managed to salvage the evening as most of them returned on
subsequent evenings to witnes our little cavalcade of comedy.
Guess you had to be there as the saying goes.
I am looking forward to the Al Flosso story.

Just a little vague info here I thought I would pass along
to LA area magi. As I was rushing the kids out to school I
heard on the radio (KROQ) that the morning DJs (Kevin & Bean)
are throwing a one-year anniversary party at the China Club
for their rapping weather man, Michael the Maintenance Man.
I caught enough of this morning's show to hear Michael list
the ten things he wanted at his party. Among them the entire
cast of "In Living Color" and scantily clad women. But the
NUMBER ONE item on his list was a magician. He said he didn't
want coin or card tricks. He wanted someone who could do something
like poke a knife through his hand ("but not really"). The DJs
threw in the suggestion that they would like someone who could
make a tiger, or better, an elephant disappear.
Anyway, if this sounds like you, they were asking people to call
the radio station. Bet it would be for the glory rather than
the bucks. (should have put glory in quotes, here!). I don't
have the phone number, but I know the station is in Los Angeles
somewhere.
They did mention they already had set the hypnotist, Tom Silver.
I remember hearing of a hypnotist with the last name Silver,
but is Tom the right first name?

Reminds me of a New Years eve show at an army Offices Club.... and now
I remember doing the same, "retreating with our lives" Since then I
have flat refused to ever work on New Years eve.
Flosso was braought out from NY for the opening party of Dr. Albo when
he published his first book. There was a jparty at Doc's country club
and he brought in aobuat 8 acts, I was the MC. Nobody wanted to
watch the show -- they were laymen, friends of Albo -- lawywers, Drs,
etc. but were mostly talking to each other and being bored byd the
magicians. Several rushed the act and left. A couple of big names from
the Castle, etc. I didnd't have the experience to handle the situation
myself at this point in my life/career.
Flosso was to close. Albo came back and said "Put Al on now" (it was in
fact my time to work, but I said OK>
Flosso went out, blew his whistle, shouted 'em down, told them to watch
now becuase THIS WAS IT..... he absolutely outwaited them, got them
quiet, made them move up to watch the show.
Needless to say HE KILLED 'EM. Then, to my surprise, when he finished,
he said, (in his inimatable style) "Here it is... Now... we present the
STAR of tonights show.... Pete Biro...."
Not true, right, Flosso was the star... but he knew how to handle and
set up that audience.
And... the plus for ME, was the aud thought I WAS the attraction, they
paid great attention and I went over very very strongly.
Had I not had Flosso set it up, I probably would have DIED just like
all ahead of him! Great Lesson!!!!

Lets see....just talked to Keith Walker head honcho of
CEMK. He's gonna sue me cuz of what I din't say about him in the
Genii. Keith, Obie and Lou Gallo are off to the Magifest in
Columbus, Ohio next weekend. Keith heard from Joe Ryan that you
were publishing some of your Kaps Letters here on MAGIC! and it
turns out he was a student of Kaps in London. He's frothing at

Fax arrived ok. Was very clear. No problem mixing w/business faxes. The
folks around here never know what to expect. You'd be surprised how
many faxes of cartoons etc come from bankers and other businesses from
across the country. All the employees here know of and appreciate my
magic backround. Enjoy the Fitzkee booklet and give the contact reading
a try. The key seems to be to get your subject to visualize your hand
moving in the correct directions. After reading the booklet lay out a
row of objects or cards (I think different objects work better) and try
it out on Gloria if you have not yet told her that it is muscle
reading. As you try to go in the wrong direction you will feel a pull.
As you go in the right direction you will feel almost no resistance.
This is if you are using the standard contact of the subject holding
your wrist. Different subjects vary widely in the strength of the
resistence or telegraphing that they do. When I used to do it I always
kept my eyes closed if I weren't blindfolded as _I_ could concentrate
better that way.

ECABALL.COM - Once upon a time I built this pinball game simulation.

note: it was built in the days when PC's ran slow
(4.77 MHz). If you run it on a high speed machine,

I remember the "tribute" and the subsequent letter from,
Paul Daniels I believe (I haven't looked it up) and Paul Osbornes
reply. I do notice on page 840 of Genii Vol53#12 that there IS an
ad for The Zig Zag from Illusion Systems (Paul Osborne's
company).
If a derivative work is based on copyrighted material, it
is necessary to obtain the copyright owners consent for the
derivative work to be copyrightable and publishable. While a
title or name cannot be copyrightable (ex: zig zag) all of these
one offs seem to be based upon Harbin's original work.
The copyright owner can divide up and transfer rights to
a work in any way he or she chooses. Some rights can be sold and
subsequently other rights to the same work can be sold to another
party.
I notice in Hank Lee's new catalog that the title page of
the Illusion section of the catalog is headed up with an
illustration of a zig zag as well as offering the plans (from
Osborne) and a Harbin Chair Suspension for around $400.
If the owner of the Harbin copyright should so desire, I
believe they have a "case", however it is up to the owner to
protect the copyright. I think the "common law" is "use it or
loose it."

I just returned from an all day magic class held in Chatsworth.
(That's in Southern California for you long distance members) The cost
came to total of $60.00 which included some course materials such as
an oversized coin. (One of those about the size of a saucer) a
Brainwave deck, some wirenuts (!) for doing chink-a-chink, a spool of
thread for doing gypsy thread, and other odds and ends. We learned how
to do a couple of versions of coins across, cards across, a few copper
silver routines, gypsy thread, and other effects. What really made it
worth it to me was there was only four students so there was all the
individual attention we wanted, AND, I was allowed to video tape the
whole thing for future reference! The instructor also showed us some
excerpts from professionally produced magic videos showing the likes of
BoBo, Johnny Thompson, John Carny, Jay Marshall and others instructing
on other effects. I thought it was very much worth it and if anyone is
in this area and looking for instructions on some good basic magic I

The copyright act offers remedies when the rights of a
REGISTERED copyright are infringed. The court can grant temporary
and final injunctions anywhere in the USA. Court can also order
impoundment of all copies claimed to have been made in violation
of copyright holdrs rights. Also infringer can be liable for
actual dameages and any additional profits lost to the owner.
Reasonable attorney's fees can be awarded and if the courts deem
that the infringement is criminal a year in the slammer and 25gs
can be levied. Infringement of copyright can a serious offense.
Again it is up to the owner to fight and a sympathetic attorney
is advised.

The zigzag question, I dare say, would be very difficult
and expensive to pursue because it is so widespread. There is no
regulatory agency in the govt for this sort of thing so it has to
be taken to the courts privately. Legal fees would be heavy. Your
point well taken on determining EXACTLY what material is
registered and how. It's a shame he didn't seek a US or UK patent
registration (or did he). US Trademak protection is valuable also
and is cheap and within the "do it yourself" range (I've done
three US and several state) if you are patient and speak heart to
heart with the US lawyers on the otherend. I'm no lawyer, I'm a
user of the system having done over 200 copyrights as well as the
other stuff related to publishing books, tapes, cds etc.
You can search the entire state and federal trademark
records off Compuserve by GO TRADEMARK. There is a stiff fee for
this service but for 25 bucks I can search any mark in the US and
be reasonably assured the mark will go through with a minimum of
wasted time. Biggest hassle is the pen and ink drawing - you'd
have that part licked.

Er, I don't know what you were having happen with MAGIC-NL. When I
called it worked fine. It sounds like somehow the modems failed to
"handshake" properly. Sometimes weird timing problems happen on the
satelites. I don't think either your modem or ProComm are at fault -
more likely to be sunspots. Also, of course, MAGIC-NL is just getting
going and it could be that it "glitched." Maybe try again in a day or
so?

Could you expound on that thought a little more- that most mentalism

if you were able to tally up ALL of the magic shows being performed
today, that most of them are for children. Another one of our members
on this board has said that he has had great success doing mental
effects for children in the nine year old range. That they seem to be
much more sophisticated than we give them credit for. At that age I

Sorry, I should have been more clear in what I said about the magic
class. The tapes we were shown excerpts of were not for the purpose of
replacing our instructor in the class and teaching us magic. They were
shown so we could see the quality of proroduction of the tapes and what
a valuable resource they would be for us to own. In other words, he
was encouraging us to purchase some of these tapes (and books that he
passed around) and gave us the name, address and phone numbers of
Steven's Magic Emporium, Tannens, and local magic shops. (Funny,
Abbott's address wasn't included- does anybody...)
One of the tapes was Ken Krenzel's "On The Pass". He showed us that
with the aid of a video machine we could stop and start, slow motion
etc. to see exactly how to do the pass. We didn't do that on any of
the tapes, but we were given a taste of and subsequently a hunger for
more of this medium for teaching us magic. On the basis of what I saw
I now plan to buy many of these tapes as do the other students.
Therefore Stevens and Tannens should send the instructor a letter of
thanks and not a subpoena.

I live north of the Burbank area in Sun Valley. I am a relative
new commer to magic so my bookshelf is only a bit over two feet wide.
I have mostly basic books but some good quality ones such as the Vernon
Chronicles. I saw Dai up in the Castle library early last year and I
wished I would have had them with me in case he would have autographed
them. Not much chance of that now. Anyway, the next one I want to
read is Ultra Cervon, and only because I saw his lecture which was
taken almost entirely from that book. Truly miraculous stuff.

Part of what I do for Inside Magic is gather info on magic on
TV. We put it on the Hotline or in the issue. Sometimes really
great stuff I'd love to see. But since we're always working ahead,

When you mentioned contacting Harbins widow, something stuck my mind,
I had thought I read she had died a few years ago.
Looking through my old issues of Genie, I found it, she passed away on
November 30th, 1882. This is in the January 1983 Genii, Page 72.
Maybe someone can get in touch with her (and his) estate.
Bayard Grimshaw wrote the obit, so if he is still alive, maybe he would
have some information.

The issue comes down to what the purpose of the performance art known
as magic really is. It has nothing to do with belief systems per se,
and (so far as I'm concerned) little relationship to the over-used term
"wonder" that crops up all too frequently in contemporary discussions.
To me, magic is an important element in contemporary culture, for
the primary reason that it shakes the observer/participant out of the
complacent mindset that inevitay accompanies technological complexity,
and provides a reminder as to how significant an amount of mystery
still imbues the day-to-day cycle.
Of course, children don't need this reminder; they haven't learned
to ignore mystery yet. Hence, for the most part magic is wasted on
them.

Well, I know from my software dealing that a copywrite will last for I
think 75 years after the copyright author has passed away.
The big thing is, was the idea or was the method copywrited? Also,
remeber the Harbin cabnit has a piece of wood between the top and
middle sections and the girl had to bend down to get in. Would that
make a difference, as all the zig-zags that I know dont have that piece
of wood.

I think that the info on upcoming magic on TV is truly one of the
strong features of Inside Magic. I wondered how Stan got that stuff.
Now I guess we know! You do it! Great stuff.
My collection of magic videos is not large. I was refering more to the
pattern I had of taping old movies and such like for "time shifting."
Originally, I thought that meant days, turns out that it means years.
I also buy a lot of videos, particularly discs. Lately though, with a
two year old around, the collection has tended to expand in the
direction of Bambi. He has a magic video that General Mills put out
for kids, with Dan Witkowski, and it is perfect for kids. He demands
it at least once a day and is trying to do the tricks from it. I must
also report, however, that he wasn't enthralled by Max's Mindgames,
although he was impressed with Max.

The fact remains that this instructor apparently showed the tapes
without permission of the copyright holders. What his motivation might
have been, and indeed the results of his showing them in whole or in
very small part, is IRRELEVANT. Otherwise, any person could use
copyrighted material -- such as the STAR WARS characters for example --
and try to argue that their use "created interest" and new customers
for the copyright owners. It simply doesn't work that way; you have to
ask FIRST, and then be granted permission -- and it is best if both

For published works copyrighted prior to 1/1/78 the
duration of same is 28 years and could be renewed for an addl 28.
For works after this date it lasts 50 years after the authors
death. In the case of joint copyright this applies to the death
of the last partner. This 50 year rule is consistent with other
countries who've entered into copyright treaties with the USA.
In the case of anonymous works, works made for hire,
and pseudonymous works the copyright endures for 75 years from
its first publication or a term 100 years from its creation
(whichever comes first).
Although a copyright owner has certain excclusive rights,
there are some limitations that Congress has imposed that are
referred to as "fair use." There are certain advantages that
libraries and "non-profit" educational associations enjoy that do
not constitute infringement. The library and educational "fair
use" rules apply only when there is no commercial advantage
gained or the library is open to the public.

As I recall that fateful night had several elephant sized women. They
were all a little crazy too. Next time you see Ray ask him to tell you
about our escapades in Norfork, Va. during the IBM convention a few
years back. We still laugh about that one. Yes, Ray is great. We grew

short.

You are handing me a heavy assignment that I'm not certain I'm prepared
for. I suspect, however, that there is no single _universal_ purpose
to magic as a performing art. Each spectator brings his or her own

I suspect that Tabby is correct - that the display of small segments of

In the old days, we used adhesive tape to splice audio and video tape.

I know about wire recorders. My Uncle used to tell me the problem with
quality was the wire didn't always go back thru the same, that someone
need to come out with someting FLAT to be correct. Then the tape was
available and you know the rest of the story. He was an electronic
whiz genius in the 30s -- holds Guiness Record for most consecutive
Short Wave contacts from Oakland Calif., to someone in Australia.
Nearly five years straight without missing a single day! Man, no
vacations, no nutt'n. He had to be home before midnight every night!

Something I forgot to mention yesterday about the magic class. It has

I believe what you say about the copyright infringement is more than
likely technically true. However, if I were one of the creators of one
of those magic videos I not only wouldn't mind the instructor showing
excerpts from them I would encourage it as it would surely boost my
sales. The instructor probably ought to get a small commission!
Look at the intent here. It is not to take away business from the
video sales people by showing complete tapes. It is only to let
students know that this medium exists and what an advantage it would be
for them to go out and BUY them. Now if any dealer anywhere were to
tell him to cease and desist I'm sure the instructor would have no
problem with that. He certainly isn't receiving any economic benefit
from it. By the way, he also had several basic books on display and I
suppose the publishers might have some right to not let him do that
either. Again, these were not used for instructional purposes. They
were shown so we could see how we can learn more about magic and we
were given names and addresses of dealers that carry them. I think it
is just a technicality in this situation and given the choice he
probably wouldn't go to the trouble to secure written permission from
every dealer and publisher but would simply omit that valuable
information on display at his classes.

That is some record your Uncle holds! I always wanted to get involved
with ham radio, but never have. Per Tabman's suggestion a few messages
back, hams DO have both radio-linked electronic communications systems
and actually have their own BBS in space! Yep, a small system (like
MAGIC!, but, of course, dealing with ham radio topics) on its own
satelite!
Wire recorders were fun. I still have my own, non-functioning, one.
The wire was .013" nichrome. It was very useful in some types of
pyrotechnic magic too. Six to twelve volts would cause it to get very
hot.

other day. It is a folder for keeping papers/reports in - the kind
kids use in school. But this one is a one eyed jack. Kinda generic

Fair use is usually interpreted as quoting of small segments for review

It seems to me that it is possible to interpret the intent as being
that of wanting to enhance the value of the class by showing parts of
videos, making the class more desireable and thus more profitable for
the instructor. Again -- INTENT does not matter; it is irrelevant.
Intellectual property is just as real as any other kind -- and if
someone comes into my apartment and steals my TV set, it doesn't matter
if he's doing it so he can show the neighborhood kids Sesame Street.

Whenever a question of fairness arises everyone has a
different idea, but the following criteria are what the court
looks at to make a decision:
1. The purpose and character of the use (intent?),
including whether such use has a commercial nature or is
nonprofit educational uses. The court will allow more leeway if
not for commercial gain.
2. The nature of the copyrighted work. There is less
chance to use a work with only entertainment value vs. something
with social benefit. If the nature of the work is educational or
intellectual it is more likely to be considered fair use.
3. The amount and substantiality of the portion used in
relation to the copyrighted work as a whole. It may be
permissible to take some parts of the other persons work, but you
cannot take too much. The more you take the more you're in
jeopardy of infringement.
4. The effect of the use on the potential market for, or
value of the copyrighted work. Here the question is, "How much
damage in lost business will the owner suffer as a consequence of
someone using the work to detract from sales.
Since the teacher used excerpts as examples of what is
available to the magic buying public I would imagine that this
constitutes fair use.
My source of information is the Revised Copyright Act of
1976 which came into effect in 1978 and preempts the Copyright
Act of 1909 and common law and "Patents, Copyrights, and
Trademarks" by Foster and Shook. Addl information on copyrights
may be obtained by writing the Copyright Office, Library of
Congress, Washington, DC 20559.

I agree that it might have been in everyone's best interest if the
instructor had checked with the copyright holder prior to using the
segments. As Tabman has pointed out (and neither of us are lawyers nor
are we attempting in any way, shape, or form to pretend to be providing
legal advice) the manner in which the segments were presented is very
likely to qualify under "fair use." Granted that the instructor is

just uploaded a mahjongg game with tiles that reflect a magical
interest. He says that one even relates to MAGIC!
At the moment, due to some constraints, I haven't been able to review
this file personally. But I wanted to get it posted without undo

The file is in the MAGIC! files area as MAHJONGG.ZIP It will require
the PKUNZIP program to uncompress it once you have downloaded it.

TA -- I spoke with Joe Stevns about it yesterday and what he likes is
a COURTESY call from the instructors, et al, and he is happy to grant
permission. What he HOPES does not happen is the LOAN out of the tapes
so copies can be made. He acknowledges viewing by magicians is GOOD
ADVERTISING and boosts sales.

Did you see CHER at the Mirage on TV last ngiht? I saw part of it. I

I have just set my prompts to hear bells ringing. Now at least I will
know where they come from. I have asked David to add some whistles so
MAGIC! will have all the bells and whistles!
Have you seen the commercial for answering machines using a dummy
machine with Bells and Whistles on it? I would like to have a magic
prop like that. I do have one SIMILAR. You put a deck oif cards into
it, press silly buttons and throw fake switches and the deck flies out
the other end. What it does is switch from a straight deck to a
Brainwave deck. The machine supposedly turns the spectators mentally
selected card over and changes the color of its back.
Are you listenin' TABMAN... Boy a nice rose wood uniet would make uyoiu
the only one in the world with one.
I forget who made this for me. It was written up in ABRA Donkey's
years ago. If anybody else knows of this prop and who made it lemme
know. I am in the early stages of -- er the disease, I forget its name
-- that relates to your memory... I

OK. I'm just about finished with the frame and then will
have the mat professionally cut and mounted under non reflective
glass.
The frame is of antique mahogany shaped here in the
tabman shop. It resembles a Thayer Handkerchief Frame. Since the
shaper bit is a standard cutter I doubt if I'm stepping on
anybodys toes. Also, I didn't set out to copy the Thayer shape
never having given a handkerchief frame much thought. It was
recently pointed out to me by Howie Schwarzman on a visit after
viewing a couple pieces of my frame art. Later in his magic
dungeon he showed me an original Thayer frame and he's right.
Even the antique oil finish I use here makes this stuff look 50
years old. I probably saw one in an old GENII ad when I was a kid
and was struck by its' beauty.....Anyway, sue me if you think I'm
wrong.
The FRAME is NOT the thing. Its what it's displaying that
really matters. Rest assured that this frame will show its'
contents off in a classy manner befitting and crafted with much
respect to both Joe Berg and Theo. Bamberg and the donor of said
instrument. His or her donation of this gift to MAGIC! will
remain a secret for now (not me).
WHAT IT IS? is a check drawn on the Amalgamated Trust &
Savings Bank, Chicago, Ill April 30, 1949 for $41.95 made out to
and endorsed on the back by THEO. BAMBERG. The check has printed
in the upper left corner BERG'S MAGIC STUDIO, 30 W. Washington
St. and is signed by JOE BERG. Check #930. Cool, huh! Why was
money exchanging hands? Did Okito finish some Berg magic? Berg
buy some appartus? If any information comes to light I will share
it with you, of course.
Framed size will be about 10x13 (inches) and will have
the front of the check showing, bevel matted and carrying a lazer
copy of the reverse signature showing in a window beneath the
check.
To me this is a pretty cool piece of magic history and
framed in antique mahogany in a traditional magic style will be
nice. Wish could I bid, but I'll have to let this one go by and
hope that the hands that finally hold this will respect and enjoy
as much as I have during the brief time it is here at tabman
springs. Bidding will commence next week as soon as I have the
finished piece in my hands. I will post a notice then but wanted
to avoid putting a long descriptive up at that time. As usual all
proceeds will go to M! World HDQ to help MAGIC! meet its' fiscal
needs.

Vbeen calling the number at the Pentagon for the last
four days. It's the press atache ## I guess. Got it from the dept
of army. 703-697-5737. I told them I was a reporter for the
magicians network and that I heard the good general is one. I
warned her that it might sound a little strange at first and it
took a minit for her to wake up but she finally gave me that
##...but it is always busy. I'll keep trying. Somebody else try,
I don't care. Might be good for bad moral in the Iraqi army if
they found out our big general had a mystical side as well. Give
it a shot.
Guess you're in the middle of relocating. Got a thrash
(speed metal) band in the studio. Noticed the bass player has
stopped wearing his black beret since sadam beat him to tv with
it. I was wondering if he'd have it on. GI boots too. Today he's
got on a t-shirt and sneakers. The property is rockin. Most of
the dogs have come in the house though.
I cut some rosewood the other day and find I need a finer
carbide blade to get that glassy cut. Found one for 200 bucks in
a catalog. Good stuff. The walnut and cherry I'm using now came
from an old lumber mill in West Virginia for making a coupla
tabman tables. Found a co that makes antique type marquetry so I
got some and really love it for certain things.
I love card boxes of all sorts. The one you describe
sounds so cool. I can just see the action. Did you say that
somewhere you have said box? I hope to see one of the great
apparatus collections someday. I would love to see a book on
antique wooden appratus with scale drawings, etc sort of like a
class antique furniture building book. The pictures and
descriptions in Hoffmann are quite good though and he does
provide some detail. I have stuff like the Osborne series, the
Wells books, would love to have The Harbin Book. It is almost
sacred. Howie showed his to me, but I couldn't make myself open
it to take a peek. Don't ask me why.

Looks like I missed the S.A.M. meeting held last night then. I'll have
to look on my Thomas Guide to find out where Alhambra is. I've heard
of it but I'm still not very familiar with the Southern California area
other then the route from my house to the Castle and a couple of magic
shops. Meetings in the middle of the week are difficult for me to
attend since I have to rise at 5:00 am every morning and unfortunately
I don't function very well on less than 8 hours sleep. (I am envious
of people like my father who can blast full throttle all day long and
do just fine on 4 hours of rest a night!)
If it is not too far from home I will try to attend at least one
meeting as soon as I can. Thanks for the offer!
