T A- I am assuming in this discussion that the patron has an idea
of what the artist is likely to produce or would not advance the
money. If I hire ? Jamey Wieth to paint my portrait I have some
idea of what it will be like.
.
The problem with government money is that the selection of the
artist is left in a committie's hands.

As usual, Tommy, you have blown me away with both the elegance of your
concepts and with your ability to express them so well. Obviously,
despite English being my native language, I failed to say what I was
really trying to say.
The point I was really trying to make was that the performer needs to
keep in mind that although he or she is performing the effect for the
Nth time, it is new to the audience; that they are, presumably, seeing
it for the first time and that the performer needs to continue to
convey the appropriate sense of enthusiasm, excitement, etc.
In a way, I'm glad that my original remark was poorly written (!) since
it gave rise to the comments from you and from Cy Keller. I read each
of them several times. It is comments like yours (and like Cy's and
the others here) that help me to think through the issues, that trigger
new thoughts, and that keep MAGIC! fresh and new. Thank you.

Thank you, Cy. I just left a message to Tommy Wonder in which I
attempted to clarify what I had originally been trying to say. I can
see the problem that you mention with stage work, and my comment was
really intended to support the idea that the presentation has to be
kept fresh.

Personally, I've come to believe that without grounding in the
fundamentals, the "performers" of magic shop tricks aren't doing magic.
They may be doing tricks, but, then again, I've heard that there are
other types of performers who can turn tricks with very little
training.

Re: BILL SWITCH
I'm told that the committees that select the artists are usually
composed of peers from the same art form. Thus the system of awarding
government funding becomes warped and distorted. I do not believe, for
example, that one cent of NEA money has ever been given to support the
magical arts.
I happen to like classical music and between purchasing recordings and
attending concerts, I spend a fair bit of my personal income on it.
But I do think that it is very questionable that it should be entitled
to government support. I think that the popular/Rock music enthusiasts
would have a legitimate gripe - why should government, which, after
all, is spending other people's money, make a decision that supporting
some art form is justified and that supporting another is not?

I have nothing against artists getting funding of various kinds -- but
the government is a very different thing than individual corporate

group sponsors in the private sector, and the company or artist needing
funding can approach those in synch with their aims.

Re: BILL SWITCH
Cy,
I think you are making an assumption based on facts not in
evidence.
Ballet, opera and orchestras survived for hundreds of years
without the aid of the U.S. government. I have real problems
with just saying that the government shouldn't give money to
these art forms, however I also have real problems with earning
ten dollars and only getting five because the government is
giving the money away.
I have to imagine that if we weren't taxed so highly, there would
be more of an incentive to support the arts. Maybe this wouldn't
prove true. There is no way to find out. (One of the reasons I
was reluctant to get into this conversation in the first place.)
From a purely capitalist point of view, if there aren't enough
people who want ballet, opera and orchestras to support ballet,
opera and orchestras, then perhaps they are not long for this
world regardless of what the government does.
I think more likely, without funding the ticket prices would be
driven higher. Perhaps this would diminish the number of new
fans of these art forms, and you would be right in your belief
that this would destroy these art forms.
I'm just as confused as ever.
Enjoy!

Tommy Wonder posted the following msg:
The only thing art is responsible to is itself.
If someone pays for it like government, a private person or
whomever, no way should the artist conform to their wishes, one
is not responsible to the person who pays! This person does not
pay an employee, but instead buys a product. If they do not like
the
product, fine, do not buy it anymore, but do not complain, after
all the artist, if he is honest can do nothing else but be
thruthfull to his work. Artists are employed only by their work,
their work is the one and only boss, not some mere idiot who does
not know half what the work is about. One's work must be free to
be able to exist, nobody can or should tell the artist what to
do. If you like it you can buy it, if you do not like it, then do
not buy it. After all, you are not obligated to buy.
If you give an artist an assignment and pay him for it, this
artist is not a hack by definition, you just trust the artist
enough(because of earlier work) and hope the result will please
you. If not, bad luck, that's the risk one takes. But the artist
MUST be free to obey to what his work dictates, otherwise you
will have
killed all possibilities for art to come into existence! An ugly
thought to me.......

I don't think magic, performed well, is as benign an art as we are
suddenly making it sound. First of all, there are still several
religious sects that view it as iniquitous. And it is a direct threat
to the nicely planned world of the MBA. It is a statement that there
are forces beyond those already understood by science. It doesn't
leave one with a nice, neatly wrapped world.

I can't see the world quite so purely as you do. I think that there is
art in the work of the patron as well as art in the work of the artist.
To dismiss the one role and to suggest that the patron is merely an

For all you Houdini fans, here's an interesting bit of news. William
"Captain Kirk" Shatner is discussing plans to get his play on Broadway
by talking to several theatrical producers. The play called "Harry and
Arthur" is about a fictionalized encounter between Harry Houdini and
Sir Arthur Conan Doyle. If he gets it on Broadway, it seems likely at
this point that Shatner will play Houdini. Guess who he wants to play
Doyle? Leonard Nimoy! I guess 25 years together on Star Trek wasn't

Arnaud,
Please post this message for Tommy Wonder
Tommy,
For the most part I agree with your statements about sponsoring
an artist. In fact, I agree completely.
The only problem arises when the sponsor isn't an individual. Or
even a corporation. The tricky part comes when the funds are
received from a government.
I don't feel that there is any problem with the government
setting forth standards under which they will give money. If an
artist can't be true to himself and stay within those standards,
he is not under any obligation to take the money.
"To thine own self be true" means not putting yourself in a
situation that would cause you to comprimise your beliefs.
Enjoy!

Re: INFOMERCIAL
Early this mornning (5:30am to be exact) as I was running
through the channels on satellite I came across Michael Ammar's
infomercial for his tape "Icebreakers". It was being shown on
CNBC. As normal the half hour "show" was filled with flowery
language touting the amazing ability to learn and perform the
tricks described in the tape. Included were a wide range of
testimonials from a variety of people including one from Mike
Ellis and people who have apparently learned magic from eithe
Michael personally or through the tape (most of the people hail
from Austin, where Michael lives). And co-starring in the show
is Glenn Falkenstein.
.
For $49.95 you get the tape and if one calls within a half hour
of the show they throw in Micheal Skinner's 3-card monte
routine. The program is produced by a company called Rainbow
Financial.
.
While I did not get to see it from the very beginning (I saw
about 20 minutes of it), it is well produced and Michael should
sell a ton of tapes...pretty soon we'll see Michael sell tapes
on how to buy Real Estate and Foreclosure properties with no
money down except for doing some magic...Dave Del Ammar.

Kevin, I have had quite a lot of luck with flash cotton and flash

laws about sending "flash material" through the mail. The laws are
VERY STRICT about sending explosives through the mail. Just thought
you might want to consider this. Let me know what your thoughts are on

Last night at the Castle was JAMMED to the rafters! LOTS of people.
The system needs some maintenance and has had a couple of "phantom"

I'll probably be making the changes in the next week.

Mystina puts on a good show. She keeps the energy up, and seems

problems that some of the magicians were having leads me to

Re: FLASH
Gary,
Okay, you sked for it.
There are good reasons for the laws regarding sending explosives
through the mails. However, I don't consider laws to be written
in stone from on high. If I send David two or three flash bills,
and the worst happens, (everything is set on fire) the worst that
would happen is there would be one tiny extra "poof." As far as
getting caught, these bills are undetectable. They look, smell
and feel the same as a regular dollar bill. They don't ignite
easily enough to be a danger. Since I'm putting no one in
danger, and the chances of getting caught are slim and none, then
I have no problem sending through the mail. Thanks for the
information though.
Which recipe do you use for your flash paper? Is it the same
recipe for flash cotton and flash string? (I know, you use
string or cotton, but besides that.)
Thanks!
Enjoy!

Re: SATURDAY NIGHT
I think that the Saturday night restriction to members and guests DOES
help, but here's what happens . . . Basically, the Castle can control
the number of dinner reservations - I believe that they keep it to
something like 375 (I think I've heard that number, but haven't
verified it) plus the two Houdini Seances - 24 more, or right around
400 people. BUT any member can bring up to 7 guests without having
dinner and without making reservations - so another 200 or more people
can show up without reservations. That means that the place can be
jammed! On the other hand, I've been there on some Saturday nights
when it has been pretty quiet. As a general rule, we try to avoid
weekend nights unless we have guests.

Re: ORTIZ
On Saturday Darwin Ortiz lectured at the KEN_ZO Party Place in
Baltimore, MD. Darwin is one of the most hard-working gambling
experts in the world.
.
Most of the effects, with the exception of the Torn and Restored
Card, are from his book "Darwin Ortiz at the Card Table". The
items were the following:
.
Jumping Gemini
Hitchcock Aces
Dream Card
Darwin's Three-Card Monte
The Vegas Shuffle
Torn and Restored Card
Regal Aces
Darwin's Wild Card
.
Darwin took great pains to explain every detail and nuance, and
the idea behind the presentation.
.
Highlights were the Dream Card and the Torn and restored card.
The latter is a development of LePaul's method with the first
good reason to tear a corner off the card and then to restore the
card. It took 6 years of development for Darwin to come up with
the presentation and changes in technique.
.
Versions of the Dream Card hve been dealt with lately as in
the Genii with the Pendragons on the cover. It is a fusion effect
and is incomprehensible to an audience.
.
If you get a chance to see Darwin, it's well worth it.

Re: BINARELLI
Just got "Class Act" by Gary Ouellet. This is the magic of Tony
Binarelli, an Italian magician well known it that country for TV
and other venues. The Book says that he is as well known as
Copperfield is known if the States.
.
197 pages at $30.00 and well worth the price. Some great ideas.
Some of the items call for props devised by Binarelli. They seem
to be available from the publisher and I know they are available
from Busby.
.
I will not go into the whole book, but want to mention some of the
items I might be tempted to use, or bring up some essays of
interest.
.
Magical Stagecraft - an essay on the use of volunteers, the venue
and applause. Excellent advice from a pro.
.
Binarelli's New Marked Deck - Great idea! Marking Bee Brand so
the card is read after it is back in the deck.
.
The Truly Ultimate Open Prediction - Good method with a new
adhesive method. Does not follow the challenge exactly, but close
enough.
.
Resurrection - This and The Phantom Visitor use a new method of
using the Thumb Tip which could lead to new effects. While
enclosed in a plastic bag, a bill or whatever is produced in the
hand.
.
Magic Wallets - Great essay on the available wallets and
their uses, which leads to a description of his Superwallet. The
wallet combines many of the described wallets in one. This wallet
is a pocket secretary. The width in the book is 11.5 cm wide
which is listed by Busby as 4 1/2". This seems a bit wide for the
pockets in my jackets. They should fit - but tight.
.
Great Wallet handlings of his wallet.
.
The Giant Card to Wallet -Three Small Jumbo Piatnik Cards
appear one at a time in the wallet. No palming; and very clean
handling - almost no moves!
.
Okay, The Price is Right - Marvelous mental and comedy
routine with a great surprise finish. This item plays for maybe
10 minutes and could well be the source of a reputation and
repeat bookings. Since the climax depends on a tax on clothing I
personally will find it difficult to use in Pennsylvania or
Delaware who have no such tax. Its a prediction of the guessed
prices of clothing which three spectators remove and price.
.
The Card Found in the Street- Great platform effect.
I understand that Tannens had a version of this by Garcia.
It is a very entertaining effect. A freely - honest - card
matches the card from another deck in the wallet.
.
Selection of Effects - An essay on how to choose and develop new
items to use in your act. Good advice.
.
The Cincinatti Kid Poker Game - A version of the ten card poker
deal. Very Clever and one I definetly will use. The spectator and
you shuffle and there is no looking for the Jonah card. The
climax needs a move but the rest is great. There is no way the
spectator can beat you playing the game.
.
Binarelli Challenge Cards to Wallet - A verson of the Jumbo cards
to the wallet for close-up. The final card is in an envelope in a
spectator's wallet.
.
Well, that's an idea of the items in the book. Some good
platform, some good closeup and some great essays. No halfway
ideas - all well thought out and routined. For someone looking
for new items, should be one of the best in '92. If, like me,
someone is intrigued by the wallet items, spending the big money
for the wallet is a good idea. Not everyone in the area will be
doing the tricks. One of the advantages of high prices.

There are some printed bills for torn-restored, etc. that are very
close. What I would suggest is finding some really "close" LOOKING
paper and get someone to print 2/3rds of ONE SIDE... less ink, and
will burn faster... thinner paper... etc. when folded WHO CAN TELL.

Re: FLASH
I used to do a trick (I think Bob Swadling invented it) using a
piece of flash string with cards. You have an Acrobatic Card on
the bottom of the deck. Set the flap. Have selected card replaced
on top of talon as you cut... placing the selected card so it will
be flipped over if you let go... (I forget the exact placement, etc.
but if you fiddle with it you can work it out) [What you want is
the Card on top with ACRO set under it] You then tie the string
around the deck, saying something like, "With the cards tied up,
I cannot do any moves, blah blah blah..." You light the string and
VOILA the acro causes the top card to flip over and it appears
in a flash!!!
.
A flash card would be too thick to burn. You can just cut a piece
of flash paper to size and tack on with a little wax.

Sometimes stuff just happens with computers - it is a sign of the
advancing intelligence of silicon life forms - they are learning how to
quit working and go on welfare. We had the same thing happen here - a
"bit" changed itself one day with no apparent reason.
Methinks you'd better take that "cold" to the doctor. Seriously.
When you drove from Brentwood to your place in 5-hrs. 10-minutes, how
much longer did it take the CHIP to catch up with you? Now that you

How is your MAGICLOG & MAGICREP script working ? I changed mine

like that.

Try changing the last line of your MAGICLOG script to WAITQUIET 1
FOREVER, that should fix it. I had changed my script to be like
yours and started getting truncated downloads, since I changed back
it has been ok.

Being able read the LOG file correctly is a different problem. There
is some junk coming off the line ocassionally that screws up the
IMP! read process.

May be up there in May (redundent?) for PCAM. There is talk of my being
hired to perform in the close-up show as well as give a lecture. I hope
so, it would be a blast.
Right now I'm preparing for my week at the Castle, which basically is
a run-through for the convention show. It's shaping up to be a hell of
a show! I'm going to have it taped and when I get some copies made I'll
forward one to ya so's you can see the performance.
The convention group are pretty gung-ho about my working it as I am a
former PCAM winner ('90 Comedy and 2nd in close-up), and they feel that
my offbeat outlook at magic would be a refreshing change from the usual
card masturbation.
Will let you know as things progress...till then, take care...

At one time I considered the criteria to be hired to work a major
convention evening show was the act had to wear black alla time.
That has changed. I bought black outfit but once it hit the
washer/dryer it turned medium dark gray fudge wrinkled looking.
I guess the big time black outfits are sent out for dry cleaning.

As I told you a few weeks ago, Dick Koornwinder got in contact

Kaps. The idea is still growing but they still have to find an
interested TV station here in Holland. I just had Dick on the

a look in the dutch TV archives.
He already knows they have a unique piece of 35mm movie of an old
Kaps TV show called Kapssallon. The piece runs for ca. 30 minutes
and comes is from 1961. He (Dick) will do his best to get himself
some material.
Will keep you informed about the progress on this.....all looks

Yes there is an art of the buyer( patron as you call it). That is
to choose the artist carefully when one wants to give an
assignment, or when one buys a finished piece of work. I think
that in the case of a finished piece of work nobody would argue
with the fact that one can never complain later on about not
liking the work. Still I feel that when an assignment is given
one should give the artist full
freedom and accept what he or she comes up with. If the buyer is
allowed to make artistic judgments, then who is the artist? If
the buyer wants to make artistic judgments, he should become
artist
himself. If not, he should let the artist make all the jugdments.
Otherwise the artist will not be able to be integer to the work,
and that is essential. If an artist cannot be integer to the work
it is the end of the work!

A good BUYER, we hope, has made the ARTISTIC JUDGEMENT on the
artist "purchased"... and that is the end of the buyer's job. Altho
the PRODUCER/DIRECTOR (if there is one) CAN be involved in making
the final call with the ARTIST on the artistic side, so as to make
it the best possible FROM THE ARTIST to MAKE the statement that
the DIECTOR wishes to convey.

The big trouble with MOST magicians is that THEY DO NOT WORK WITH
A DIRECTOR, CHOREOGRAPHER, WARDROBE DESIGNER, ETC... and often are
too fixed in their ways to keep GROWING artistically.

TO: Tommy Wonder
VIA: MAGIC-NL/NETHERLANDS
I have never had the experience of being the Senior Patron in the
performing arts, except for hiring magicians and other performers for
specific occassions.
I have had experience in commissioning artists to produce works and
I have found that it is not just a matter of selecting the artist and
then handing them the money. There seems to be a relationship between
the patron and the artist that needs to be developed with considerable
care. To put it bluntly, artists often need more than money in order
to produce art. They need "stroking" and appreciation and they need a
sense that what they are doing matters. If the artist resents the
patron, the artist will become a hack and will create the work
grudgingly. On the other hand, if the artist respects the patron, then
they will become more involved in the work. I have also found that
without some involvement by the patron the work will "drift" and even
may never be finished! Certainly, you are right that the patron must
allow the artist the room to transfer his or her "soul" to the work,
but the patron has a greater responsibility than simply handing over
the money.
By the way, it is this lack of relationship that I think is another
negative in overnment funding of the arts.

I'm assuming that integer = integrity. If the patron doesn't like
the work it is put into a closet and another artist is commiss-
ioned. I think this happened with L B Johnson for a portrait. The
popes would have changes made, I think. After buying the object,
does the owner have the right to make changes. Now there's a
problem. This has come up within the past year.

Its puzzling about the interaction of patron and artist. Joseph ?
Karch ? took a great photograph of Winston Churchill; and I
understand the only interaction was that he snatched a cigar out
of Churchill's hand and then snapped the picture of the Prime
Minister glowering. It is one of the greatest Photographs of
Churchill ever. Patrons just have to trust the artist.
.
How this fits into the government subsidising art, I don't know.
Perhaps they should stay out of it. So there go symphonies,
ballet and opera just like vaudeville. I hate to see any art
vanish just because it is not popular. Catch 22.

Methinks the Europeans use bigger wallets... most carry them
outside thier coats, like a handbag! Kaps used to have a "Holster"

It isn't gaffed, but what it does is hold close up stuff and keeps
your suit pockets from bulging and losing shape.

Yes, indeed, that is a great photograph of Winston Churchill.
I don't know that symphonies, ballet and opera would die without
government support. Although I do know that we pay a heck of a lot for
tickets and probably wouldn't pay much more. But if an art form isn't
popular enough to sustain itself, should it be sustained by government?
And, if so, what about other arts that aren't so supported?

As far a Darwin is concerned, I've been one of his biggest fans since
Hartford, back at the SAM convention in 1979. That was when Bob Read
came in and blew everyone away. And while I thought Leonard Green was
terrific at FISM last year, I just can not understand why Darwin didn't
place in the card competition. Darwin was great, his technique was, of
course, flawless. Yet, it was as if the audience folded their arms and
said to themselves, "This guy BTER be GREAT." As if their expectations
for him set him up in an impossible way.

Most of the show tickets wouldn't cost so much if the Unions that
pull the curtains and turn the lights on and off didn't DEMAND such
large crews and minimum hours of shifts.
.
And, certain theaters REQUIRE huge orchestras. Example: Victor
Borga doing his ONE MAN SHOW some time back in San Francisco, was
onstage ALL ALONE... during a bit he chatted with the audience and
said, "Do you know this theater requires 60 musicians. Look..."
(he asked the rear curtain to be lifted and there were about 60
musicians milling around, sitting, playing cards, etc....) He then
asked them to all get their instruments, quickly... as it was his
birthday and he wanted them to play HAPPY BIRTHDAY. They did, the
curtain closed and that was it. It was his Birthday every show! He
showed them they at least had to PLAY for their pay!

Re: BILL SWITCH?
Yep. We were doing a trade show in Chicago one time and the set up was
on a Sunday. So we had to pay time and a half. Our booth was the kind
that pops out of a carrying case. But house rules said the Union
carpenter had to put it up. Minimum time - 1/2 hour. Then the
electrician had to plug in the outlet box - $125. But the best was the
Draper's Union. They had to put down our tablecloth - minimum time -
1/2 hour, minimum charge - $65. And the official draper didn't even do
the work! He stood at the end of the row and watched (rule was he had
to be able to see the work being done) while some poor shnook they
hired for maybe $4.25 an hour (and a dozen of his buddies in the other
booths) spread the table cloth. Let's see. . . . 12 table cloth
spreaders at $65 per half hour = I don't want to think about it.

Darwin uses a clip-on mike with a battery activated receiver-
speaker. Binarelli should have used something like this at FISM.
He is a pro and should know better. This setup is perfect for
those close-up performances when there is a band in the room.
I've had that kind of thing often in the past.
.
I've seen Daryl's price sheet where he states he will not perform
if there is a band in the room. The above mike system is the
answer for all venues - particularly Trade Shows.

Re: BINARELLI
Binarelli describes the wallet "pretty thoroughly" but does not
describe the Himber mechanism nor the placement of the zipper.
Having a layman make it up would be a problem. Busby describes
the material of the wallet as faux crocodile. I think that may
mean that it is not even leather.
.
I'm not sure there is an advantage in having all of the wallet
types combined in one. You can only use one method in a perform-
ance.
.
I hate to quote Aristotle but here he is:
"Each instrument has the finest finish when it serves as
single purpose and not a variety of purposes."
.
The Kaps wallet for example is better for the signed card to
wallet as a repeat effect. His use of the Bendix Bombshell method
is not as good as the palming in of the card. Just a personal
choice.
.
A small pad for the switching of pads is better than the huge
wallet.

Re: BINARELLI
The book does not contain a "rights to construct" caveat as many
books and magazine articles do. By inferenced you make the props.
.
I'm opening a can of worms - or perhaps closing it. The problem
is with "theft of intellectual property". This is something that
has bothered me for quite a while. I paid good money to Al Koran
when he was in Chicago for the 5 star routine with a wrist watch.
The best thing in the purchase was not the watch method, but the
deck idea. Everybody is now using the deck.
.
What is a performer who is out of the mainstream to do when
finding new items. Should I shun copies?
.
Lets now take Binarelli's book which has some great ideas. Are
they all his? No! Take the following credited but perhaps not
authorized use of "intellectual property".
.
The Binarelli Wallet uses the ideas of Himber, Kaps, Bendix.
Benarelli does not give credit to Ed Balducci, the inventor of
the end loading pocket secretary. Kaps just eliminated the use of
the pad as the loading mechanism. Incidentally he can't spell
"Brooke". Henk Vermeyden's Add-a-Note.
.
Here is a list of people who had the "intellectual property"
which Binarelli used in his routines. Syd Bergeron, Fred Kaps, Ed
Balducci, Tony Slydini, Block, Cassidy, Henk Vermeyden, Al Mann,
Jay Sankey, Larry Becker etal. There may be more, but that's the
idea.
.
He mentions Tannen as using some of his ideas. Does he resent
this? There is a picture of Binarelli at a Tannen's Jubilee and one
with Tony Spina. The quote on Tannen's publication of theIndex
Wallet is non-pejorative. It looks like no hard feelings.
.
All of the great magic creators have stood on the shoulders of
giants. I may be corrected, but perhaps even Max has based an
effect on Annemann's Pseudo Psycometry. Perhaps Max may ave some
input into this question of "intellectual property".
.
More later...

Agree that great technicians aren't always the best performers,
but I think that the reverse - being a technician does not mean
that you can't entertain. Too many magicians, who don't want to
perfect the basics and practice, don't understand that you can be
a technician and entertain as well. They should look at Thompsoni
and Sheets to understand that no-talent entertainers? do the art
of magic no favors.

As to patter and presentation, I think that you have to make something

"field testing" and refining and it seems to me that if they publish
the patter and presentation then you are equally entitled to it.

Hey David! Got more good news which you might wish to add to my
previous message. We have just confirmed Carl Ballantine to be at the
Day Of Magic as well. I'll keep everyone updated as we hear from more
people. We have several BIG names that are in the negotiating phase at
this time. AND, we are also beginning to book for the 1993 Day Of
Magic which will be May 8 & 9, 1993 at the Queen Mary in Long Beach.
This will be a two day event, rather than one day. We have a tentative
promise from David Copperfield to be with us then, but we'll announce
the 1993 event officially on May 2nd so keep this part quiet for now!

Wow! It sounds like both Day of Magic '92 and Day of Magic '93 will be
super events! Great! But as to keeping anything quiet . . . Well, uh,
you posted it in a public message on MAGIC!
I do know that D. C. was bothered by the crowds that ganged around him
at FISM. He had hoped to be just another attendee and to enjoy the
event. If he is planning to be at D of M '93 as an attendee, you may
want to make sure that some courtesy is extended to him in that regard.

This has been discussed before. I think the "rules" are simple to
understand, and well established: _unless_ defined otherwise by the
author and/or publisher (in which case such information should be
provided up front prior to purchase), it is generally understood that
buying a book entitles the buyer to perform the material. It does not
grant that person the right to manufacture or market items from that
book for sale to others.

I am not sure about this; neither the index wallet nor the Himber are
the exclusive property of Binarelli, of course, and I don't know that
combining the two makes something unique. It might also be pointed ou
(out) that he uses the Bendix zipper and the loading technique, neither
of which are his. Years ago, in MAGICK I think, I posited using a
Himber wallet as an index device; this used the flap-type Billfooled
but the principle was the same...
...all of which is a long way of saying that No, I don't think it
would be theft. This is quite aside from the fact that the description
of any prop in a book is usually construed as tacit permission to make
one for private use.

Re: DARWIN
Card winner, Lennert Green will be at Stevens DMS... as will a
couple of the other "hot" guys, but not the winner... the rope
routine was one long continuous 'STAND UP' sequence, much the same
as Sandsational or the Frenchman I used at a recent convention
(Name brain not in gear yet this morning)...
.
Ali Bongo and I (both on the Jury) figured he didn't have a chance
to win so we each gave him about 60 points (we decided that anyone
that was NOT CLOSE would automatically get 50-60 points... AS
YOU NEED 80 to win anything....) When they announced the guy as
the winner we both jumped up and wanted to change our scores to 10.
.
But the "agreed" deal was NO CHANGING scores after positions were
announced! He even had gone overtime -- the red light went on...
So we didn't think he was even in the running.
.
The Unnofficial Rule on the red light was if it went on and the
act finished in about 10-15 seconds... and the act had NOT STARTED
ANYTHING NEW in the last minute or so... it was to be ignored...
as they could have had a "slow volunteer from the audience" or
something to slow the act down... long reaction, applause, laff,
etc...
.
But this guy did only one thing... work with rope... so I don't
think it applied??????? It was in reality ONE trick, like the
linking rings is ONE TRICK... but you can vary the length, add
delete moves etc... and frankly, to run that close is stupid.
If you have a 10 minute limit you shouldn't run more than 9 for
safety...(in my opinion) (Altho I did go overtime, had the red
light come and and still won first place myslef -- there was an
unexpected accident in the room, I threw as line and got a 2 minute
laff)!!!! Judges knew this was not my doing. (It wasn't honest)!
.
But the jury in FISM won me back by giving Tim Ellis an award
even though he Did only 1 trick (rules say more than one) and did
only 4 minutes (rules say "at least 6")... he did the funniest six
card repeat I have ever seen! (Booked him for Salt Lake)... bye

I went to The Bank to close my accounts. I wanted to have the
money sent over here in such a way that I would have immediate

immediate
access to the funds was travellers' cheques. Fine.
The catch was that they didn't have any travellers' cheques in
Dutch currency actually in the bank -- they had to go to the
vault to get them. Come back in a couple of hours they said.
Fine.
A couple of hours later I went back to The Bank to get my
travellers' cheques. They were there, but the clerk who had
waited on me the first time ws gone and someone else was
handling foreign exchange. The problem was that by this time,
technically I was no longer a bank customer and the new clerk
wanted to charge me a fee for the &*%^$L!! travellers' cheques,
which were supposed to be free with the type of account I had
just closed!
.
I'm told that banks over here arfar more bureaucratic. I'll
